Preparing the Next Generation of Oral Historians is an invaluable resource to educators seeking to bring history alive for students at all levels. I have three aims in this essay. I want to offer an example of an interdisciplinary historical inquiry combining literary criticism with the relatively new field of critical legal studies. I intend to use this historical inquiry to argue that the ambiguity of literary texts might better be understood in terms of an era’s social contradictions rather than in terms of the inherent qualities of literary language or rhetoric and, conversely, that a text’s ambiguity can help us expose the contradictions (...) masked by an era’s dominant ideology. I try to prove my assertion by applying my method to Herman Melville’s three most famous short works—“Benito Cereno,” “Bartleby, the Scrivener,” and Bill Budd, Sailor—works dealing with the law and lawyers and widely acknowledged as ambiguous.1 I will base my critical inquiry into these stories on Melville’s relationship with his father-in-law, Lemuel Shaw, who, while sitting as the chief justice of the Supreme Judicial Court of Massachusetts from 1830 to 1860, wrote some of the most important opinions in what Roscoe Pound has called “the formative era of American law.”2Before I get started, I should clarify what this study does not entail. By using Shaw and his legal decisions in conjunction with Melville’s fiction, I am not conducting a positivistic influence study. My method will not depend on the positivist assumption that Shaw’s legal opinions can be used to illuminate Melville’s texts only when his direct knowledge of Shaw’s opinions can be proved. Nor will I limit myself to a traditional psychoanalytic reading: my emphasis is on political and social issues, and too often these issues are deflected by translating them into psychological ones. At the same time, I recognize that critics concerned with political and social issues too often neglect questions raised by a writer’s individual situation. I compare Shaw to Melville not to reduce Melville’s politics to psychology but to prevent a political study from neglecting the political implications of psychology, to remind us—as the title of Fredric Jameson’s book The Political Unconscious reminds us—that psychological questions always have political implications. 1. This book is a provocative contribution to contemporary ethical theory challenging foundational conceptions of character that date back to Aristotle. John Doris draws on behavioral science, especially social psychology, to argue that we misattribute the causes of behavior to personality traits and other fixed aspects of character rather than to the situational context. More often than not it is the situation not the nature of the personality that really counts. The author elaborates the philosophical consequences of this research for (...) a whole array of ethical theories and shows that, once rid of the misleading conception of motivation, moral psychology can support more robust ethical theories and more humane ethical practices. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In a recent article, Erik Wielenberg has argued that positive skeptical theism fails to circumvent his new argument from apparent gratuitous evil. Wielenberg’s new argument focuses on apparently gratuitous suffering and abandonment, and he argues that negative skeptical theistic responses fail to respond to the challenge posed by these apparent gratuitous evils due to the parent–child analogy often invoked by theists. The greatest challenge to his view, he admits, is positive skeptical theism. To stave off this potential problem with his (...) argument, he maintains that positive skeptical theism entails divine deception, which creates insuperable problems for traditional theism. This essay shows that Wielenberg is mistaken. Although positive skeptical theism claims that we should expect the appearance of gratuitous evil given Christian theism, this does not entail divine deception. I maintain that God is not a deceiver on positive skeptical theism because God does not meet two requirements to be a deceiver: God does not intend to cause people to believe any false propositions and God does not provide evidence for someone to justifiably believe a false proposition. Consequently, Wielenberg’s new argument from evil fails and positive skeptical theism remains a viable response to the evidential argument from evil. (shrink)

Epistemic Indirect Realism is the position that justification for contingent propositions about the extra-mental world requires an inference based on a subjective, experiential mental state. One objection against EIR is that it runs contrary to common sense and practice; in essence, ordinary people do not form beliefs about things in the external world on the basis of experiential mental states. This objection implies EIR is contrary to ordinary experience, impractical, and leads to scepticism. In this paper, I will defend EIR (...) against this objection by distinguishing EIR based on conceptual awareness and non-conceptual awareness. In particular, I will argue that direct acquaintance provides sufficient awareness that can explain how ordinary folks are capable of forming justified beliefs about the external world in a way consistent with EIR. Overall, I present a framework for showing that EIR can satisfy ordinary epistemic practices without betraying human nature or over-intellectualizing the required epistemic standards for possessing a justified belief. In response to the recent resurgence of idealism among a cluster of Christian theologians and philosophers, this article raises a difficulty for Christians to be idealists. Unlike traditional accounts of Christianity that must explain why God permits or allows evil, idealists face a different and more difficult problem—namely why does God willfully and directly produce experiences of evil. Because the metaphysics of idealism requires God to produce experiences of evil directly and willfully, it is difficult to reconcile it with the (...) essential goodness of God. The existence of matter, therefore, may play an important role in maintaining God’s innocence while allowing creatures to exercise free will. (shrink)

The problem of peer disagreement represents a growing challenge to justified religious belief. After surveying the state of the dialectic of the problem, I explore three ways for religious believers to remain steadfast in light of religious disagreement. The first two ways focus on the believer’s basing his religious beliefs on a direct awareness of the truth or evidence of his beliefs. The third way considers the virtue of faith as a means for resisting peer disagreement.

Plotinus was much exercised by Plato's doctrines of the soul. In this treatise, at chapter 1 line 27, he talks of "the divine Plato, who has said in many places in his works many noble things about the soul and its arrival here, so that we can hope for some clarity from him. So what does the philosopher say? It is clear that he does not always speak with sufficient consistency for us to make out his intentions with any ease." (...) The issue in this treatise is one that has puzzled students of Plato from ancient to modern times—and is indeed a popular topic for undergraduate essays even today: Why should the philosopher, who has ascended through a long and painful process of dialectic to "assimilation to the divine," ever descend back into the body? Plotinus himself is said by Porphyry to have attained such a state of other-worldly transcendence on at least four occasions during his lifetime, so this was a very real and personal issue for him. Platonists beginning in the Old Academy itself and up to and including Plotinus struggled to understand and articulate the relation between Plato’s Demiurge and the Living Animal which served as the model for creation. The central question is whether “contents” of the Living Animal, the Forms, are internal to the mind of the Demiurge or external and independent. For Plotinus, the solution depends heavily on how the Intellect that is the Demiurge and the Forms or intelligibles are to be understood (...) in relation to the first principle of all, the One or the Good. The treatise V.5 [32] sets out the case for the internality of Forms and argues for the necessary existence of an absolutely simple and transcendent first principle of all, the One or the Good. Not only Intellect and the Forms, but everything else depends on this principle for their being. (shrink)

This study makes a substantial contribution to our understanding of the development of ancient Platonism and of the influence of Greek philosophy on Christian thought. The author examines a number of themes such as Eros, Virtue, and Knowledge in the writings of Plato.

The current ethical norms of genomic biobanking creating and maintaining large repositories of human DNA and/or associated data for biomedical research have generated criticism from every angle, at both the practical and theoretical levels. The traditional research model has involved investigators seeking biospecimens for specific purposes that they can describe and disclose to prospective subjects, from whom they can then seek informed consent. In the case of many biobanks, however, the institution that collects and maintains the biospecimens may not itself (...) be directly involved in research, instead banking the biospecimens and associated data for other researchers. Moreover, the future uses of biospecimens may be unknown, if not unknowable, at the time of collection. Biobanking may thus stretch the meanings of inform and consent to their breaking point: if you cannot inform subjects about what their biospecimens will be used for, what can they consent to? Given that informed consent by individual subjects is the ethical gold standard, the seeming dilution of the concept in the context of biobanking is a profound problem. (shrink)

The role and precise significance of Intelligible Matter in the philosophy of Plotinus has been neglected or dismissed with many questions unanswered. In view of the fact that, unless this role can be properly understood, the whole doctrine of the procession of the Second Hypostasis must remain mysterious, this paper is intended to shed light on two important aspects of that Hypostasis: the nature of Intelligible Matter itself and the relation of that Matter to the Forms.

Recent scholarship has steadily been opening up for philosophical study an increasingly wide range of the philosophical literature of antiquity. We no longer think only of Socrates, Plato and Aristotle, and their pre-Socratic forebears, when someone refers to the views of the ancient philosophers. Julia Annas has been one of the philosophers most closely engaged in the renewed study of Hellenistic philosophy over the past fifteen years, enabling herself and other scholars to acquire the necessary ground-level knowledge of the widely-dispersed (...) texts and the problems of interpretation—both historical and philosophical—that they present. In her new book she takes the next step. She presents to the general philosophical public of today an extended reconstruction of the systems of moral philosophy that were developed and pitted in competition with one another during the period when refinement and professionalism were at their height in Greek philosophy—between the end of the 4th and the middle of the 1st centuries B.C. These include the moral philosophies of Epicurus and his followers, several generations of Stoics, sceptical philosophers both Academic and Pyrrhonian, and the “hybrid” theories put together by Antiochus of Ascalon and other Stoic-influenced philosophers as part of the modernizing revival of Aristotelian ethical thought that took place in the 1st century B.C. She finds significant commonalities among these otherwise very disparate theories, and much of the book is devoted to examining these and showing how the conception of ethics and morality that is common to the ancient theorists compares with and differs from what we are familiar with in modern and contemporary theory. She traces these commonalities back to Aristotle in his ethical treatises, and accordingly includes Aristotle’s theory as one among those to be examined—indeed, in a significant sense as the intellectual father or grandfather of the rest of them. She leaves Plato’s dialogues out of account, and she has nothing to say about ethics and moral philosophy in the revived Platonism that gradually came to dominate philosophical thought in later antiquity. Her book, then, is a book about the structure and content of ancient ethical theory during the Hellenistic period, the period when Greek philosophy was at its high-point in professionalism and sophistication.
